2. General conditions for the use of the website and services offered.


To use the website you must accept the general condition of use described below. These conditions may be modified or added to at any time, so we would invite users to check them on a regular basis. This website is normally accessible to users at all times. An interruption for technical maintenance could however be decided by who would, in this case, endeavour to give prior warning of the date and time of the planned intervention.

The website is regularly updated by Moderato Archi. In the same way, the general conditions of use may be modified at any time: for this reason, users are asked to check them as often as possible.



3. Description of the services provided.


The aim of the website is to supply information concerning the activities of the company. Moderato Archi endeavours to provide the most accurate information possible on the website   However it cannot be held responsible for any omissions, inaccuracies or shortcomings in the updating process, whether it be through its own fault or that of any third party supplying information.

All data provided on the website is given for information purposes, and is likely to evolve. Furthermore, the information given on the website is not complete. It is given subject to modifications being made after printing.


4. Contractual limitations on the technical data.


The website uses JavaScript technology. The Internet website cannot be held responsible for material damage linked to the use of the website. Moreover, the user commits to visiting the website using up to date equipment, free of viruses and with an up to date browser.


5. Intellectual property and copies.


Moderato Archi is the owner of the intellectual property rights and holds the right of use of all the elements accessible on the website, notably texts, pictures,graphics, logos, icons, sounds, software.

All reproduction, representation, modification, publication, and adaption of all or part of the website, irrespective of the procedure used, is forbidden, unless with the prior written consent of : Moderato Archi.

Any unauthorised exploitation of the website or any of the elements contained therein will be considered as fraudulent and prosecution will follow in accordance with articles L3355-2 and the following of the Intellectual Property Code.


6. Limitation of responsibility.


Moderato-Archi cannot be held responsible for any damage, either direct or indirect, to the user’s material when visiting the website, and resulting from the use of material not meeting the specifications defined in point 4 above, either through a virus or incompatibility.

Nor can Moderato-Archi be held responsible for indirect damage (such as a drop in the market or loss of opportunity) following the use of the website

Interactive areas (possibility to ask questions in the contact section) are for the use of the users. Moderato Archi reserves the right to delete, without prior notice, any content likely to contravene legislation in France, in particular that relative to data protection.

If necessary, Moderato Archi also reserves the right to condemn the civil and/or criminal liability of the user, notably for posting messages with racist, abusive, defamatory or pornographic content irrespective of the means used (text, photographs…..).


7. Management of personal information.


In France, personal information is protected under law no. 78-87 of 6th January 1978, law no. 2004-801 of 6th August 2004, article L.26-13 of the Penal Code and the European Directive of 24th October 1995

When using the website, the URL of the links used to access the website, the web provider, and the user’s IP address may all be obtained. In all cases, Moderato Archi only gathers the user’s personal information when it is needed for certain services offered by the website The user supplies this information in full knowledge, notably when he enters the information himself. It is therefore made clear to the user of the website whether or not it is necessary to provide these details.

In accordance with articles 38 and the following of the law 78-17 of 6th January 1978, concerning information technology, personal data and personal freedom, all users have a right to access, rectify and oppose any personal data concerning them, by means of a written and signed request accompanied by a signed means of identity, and featuring a return address.

No personal information concerning users of the website would be, without the user’s knowledge, published, exchanged, transferred, given or sold by any means to third parties. This information would only be transferred in the event of Moderato Archi and its rights being sold, and the potential purchaser would be under the same obligation to the users of the website in respect of conservation and modification of personal data.

The website is not declared to the CNIL as it does not gather personal data. The database is protected under the law of 1st July 1998 transposing the order 96/9 of 11th March 1996 relating to the legal protection of databases.


8. Hypertext links and cookies.


The website contains a certain number of hypertext links to other websites, with the authorisation of Moderato Archi. However it is not possible for Moderato Archi to verify the content of all those websites, and therefore Moderato Archi will not assume responsibility for them.

When visiting the website cookies may appear on the user’s computer screen. A cookie is a small file which is not able to identify the user but is able to register information relative to a computer’s access to a website. The information gathered is then used to facilitate subsequent visits to the website. Blocking cookies could make it impossible to access certain services. The user can however block the use of cookies by using the following configuration :

9. Applicable law and jurisdiction.


Any legal contention related to the use of the website is governed by French law. It will be considered exclusively under the jurisdiction of the relevant courts in Paris.
